Sen. Graham has responded to the questions raised about his behavior related to the fake Supreme Court brief he filed.
When questioned by the Charleston Post and Courier he justified his insertion of fake discussion with Sen. Kyl (R-Az) into the Senate records by noting that everyone does it.
And he is correct, to a point. The habit of adding material into the Senate record is not new. The manner that Graham and Kyl used was highly unusual, and clearly outside the norm, but yes, Senators do add stuff to the record all the time.
The greater question, the question that the paper somehow missed, is how many people then try to present this faked material as real to a court.
You see, this is the real ethical failure on the part of Graham (a lawyer, who should know better). He presented this false information, trying to claim that the Senate debate that was completely opposite of the real debate that had occurred, in an effort to sway a judicial decision.
He lied to the court.
And the Charleston paper never asked that question.
But you have to give them some credit, they are the only paper in the state that has looked at this issue at all. Everyone else (Columbia, Greenville, Myrtle Beach, Charlotte, Florence, Augusta etc) has ignored it.

And what people are still not focusing on is that the Kyl-Graham brief lied to the Court when it said that the material wasn't inserted but was part of the live floor debate. That's really the point here.
